We do not offer any such operation, treatment or advice that is usually given by a dentist or qualified registered professional. This page (and any documents which it refers to) states the Terms and Conditions (the “Terms”) under which you (“You/Your”) may use the Titan Mouthguards website located at http://www.Titanguards.com (the “website”). Please read this page carefully. By accessing and using the website, you accept and agree to be bound by these Terms. If You do not accept any of the Terms stated here, You must not use the website.

 

General terms and Conditions 

From time to time we may modify or revise these Terms (for example to reflect changes in technology, our business model, our system’s capabilities or relevant laws and regulatory requirements). We recommend that you should therefore visit this Terms & Conditions page periodically to review the Terms. In the event of substantive changes to the Terms, You may be notified by a notice on the website. Your order will be subject to the Terms in force at the time when you order products from the website, unless any change to the Terms is required to be made by law or governmental authority (in which case it will apply to orders previously placed by You).

Your use of the website constitutes your agreement to the terms.

The ‘Web Site’ is directed at users resident in the United Kingdom . Access to the website is provided on a temporary basis, Titan Mouthguards reserves the right at any time to modify or discontinue, temporarily or permanently, the website, any part of the website and/or any and all features and sections of the website, without notice. However, where possible we will endeavour to inform registered users via a notice on the website or email; Titan Mouthguards shall not be liable to you or to any third party for any such modification, suspension or discontinuance.

How the Contract is formed between You and Us 

By placing an order on the Web Site, You are making an offer to Us to purchase the products You have selected on these terms. You should therefore carefully check that Your order is correct prior to submission. During the ordering process You will be given the opportunity to correct any errors. After placing an order you will be directed to the payment page where you can complete your transaction. You will be charged for the goods and directed to the chosen payment page. Paying for the goods and receiving subsequent payment and order confirmations means that we have accepted your order and a contract has been formed between You and Us. At any point, We may decline to supply products to You without giving any reason. We store all contracts made and we recommend that You= file these too, as subsequently the documents will not be accessible.

 

Digital Signature Provisions

You represent and warrant that you have the legal right, power and authority to agree to these Terms and Conditions on behalf of yourself and the client, buyer, or other entity on whose behalf you are acting while participating in the site. You further agree that your use constitutes an electronic signature as defined by the Electronic Signatures in Global and National Commerce Act ("E-Sign") and the Uniform Electronic Transactions Act ("UETA") and that you have formed, executed, entered into, accepted the terms of, and otherwise authenticated these Terms and Conditions and acknowledged and agreed that these Terms and Conditions are an electronic record for purposes of E-Sign, UETA and the Uniform Computer Information Transactions Act (“UCITA”) and as such are completely valid, have legal effect, are enforceable, and are binding on, and non-refutable by you and the member, buyer, supplier or other entity on whose behalf you are acting.

By submitting any order electronically through e-commerce (online shopping cart), email, phone, or chat, you agree that either by submitting your assent through a check box, or typing or speaking authorization for a payment transaction, it constitutes a legal signature of agreement as per the Uniform Electronic Transactions Act ("UETA").

 

Prices

The price of Our products will be as quoted on the Web Site from time to time, except in the case of obvious errors. The prices quoted include value added tax (VAT). We reserve the right to change Our prices, from time to time. However, changes will not affect orders which We have accepted. We will verify prices as part of the order process and will contact Youbin the event of a mistake. If a product is priced incorrectly We are under no obligation to provide the product at the incorrect price, if the error is obvious and could have been reasonably recognised by You as an error. Please note that unless otherwise stated you will be required to pay any return postage on any impressions returned as part of the custom made process. 

 

Risk and Title

The products will be at Your risk from the time of delivery. Ownership of the products will pass to you once we have received full payment of all sums due (including delivery charges) in respect of your order.

 

Home Impression Kits  

Imprint kits are dispatched within 1-2 business days from receipt of order. 

Once You receive the initial imprint system, it is Your responsibility to carry out the imprint instructions correctly and to make a dental imprint that our technicians can work with and to then send the completed imprint back to Titan Mouthguards Ltd. in the mailing bag provided.

Should you be unsure of the suitability of your imprint please send a photo of your imprint to us at: info@titanmouthguards.co.uk and we will check the suitability prior to your sending the imprint to us.

 

Manufacture and Postage

On receipt of a customer’s imprint we will endeavour to manufacture and deliver the final product within 10 working days. If there is a problem with the imprint or availability of materials You will be contacted and informed of the expected delivery date. If you don't receive the package within the aforementioned lead times:

  • See if someone else has accepted delivery.

  • Look around the delivery location.

  • Look for a notice of attempted delivery.

  • Contact your local Royal Mail sorting office

Occasionally initial and final deliveries are returned to us as undeliverable. When the carrier returns an undeliverable package to us, a Titan Mouthguards representative may contact You to verify the delivery address before it is re-shipped.

Orders that are returned to us as undeliverable (see below) are not able to be re-shipped until the delivery address is verified by You and any additional postal charges have been settled. If the item is undeliverable due to an error by Titan Mouthguards Ltd. any additional postage costs may be waivered.

If you suspect your order cannot be delivered as addressed and a representative has not contacted you after 4 weeks from the estimated delivery date, please contact us at info@titanmouthguards.co.uk.

 

Possible Reasons for failure to deliver

  • Address is a P.O. Box. - We do not ship to P.O. Boxes, all orders must be shipped to a street address.

  • Incorrect Address -If the address is incorrect or outdated, the package is typically returned to us by Royal Mail or the unintended recipient.

  • Failed Delivery Attempts - Usually the Royal Mail makes three attempts to deliver a package. After two attempts, the package will be returned to us.

  • Damaged During Transit. - If a package is damaged on its way to you, the shipper may return it to us without attempting delivery.

  • Refused by Recipient - If a recipient is not expecting a package, they may refuse it if they believe it was sent to them in error.

  • Lost in Post – The package could simply have been lost in the post. Royal Mail do not qualify an item as lost until 15 working days have expired. 

 

Refunds and Returns

If You have any problems with Your Titan Moithguard product we will endeavour to re-place or re-make your custom made product up to two (2) times (additional photos and/or impressions may be required). Please note that this is judged on a case by case basis and is strictly at the discretion of Titan Mouthguards Ltd. There are NO MONEY BACK REFUNDS except where prohibited by Law. Any such refunds are again strictly at the discretion of Titan Mouthguards Ltd. and will be judged on a case by case basis.

We begin work on your custom made product once we receive your impression(s). Once this process begins there are NO MONEY BACK REFUNDS except where prohibited by Law. Completing an order is a large expense and is cumulative the longer we work on your product. For this reason we ask that you contact info@titanmouthguards.co.uk as soon as possible with any issues. You will be notified by e-mail if any further information or action is needed on your part. Requesting a chargeback, filing a complaint with any website/company not controlled by Titan Mouthguards Ltd. or threatening legal action will result in the case being immediately considered abandoned and all impressions will be discarded regardless of any intention to continue with the purchase. Please be sure that you no longer want you’re a custom made product before you take any of these actions.  

All requests of complaints must be submitted in an e-mail to info@titanmouthguards.co.uk is acceptable. It will necessary for the customer to provide detailed and accurate requests or complaints. At this time a Titan Mouthguards representative will attempt to respond to the client’s needs in a positive way to correct any issues and satisfy the client.

 

Chargebacks

If you decide you no longer want your custom made product and must have a refund, we'd ask that you please contact us. Once you file a chargeback with your financial institution, we cannot issue a refund. The chargeback process credit card companies provide is expensive and time consuming for the merchant and will delay any potential refund due. We can process refunds much faster and with less hassle. If for any reason you are not satisfied with your custom made product simply notify us of your desire to receive a refund, and a member of our Billing Department will review your case. If they find that a refund is warranted, you will be refunded the amount paid minus a handling and transactions fee of 15% of the full retail price of the product and minus the 3-way processing amount for every purchase refunded.

All chargebacks are answered with these terms and conditions you have agreed to.

 

Intellectual Property Rights and Ownership

The contents of the ‘Web Sites’, such as text, graphics, images, and other material, as well as the underlying html source code of the Web Site (“Material”) are protected by copyright and other applicable intellectual property laws around the world, and are owned or controlled by Titan Mouthguards Ltd. or by third parties that have licensed their Material to Titan. Unauthorised use of the Material may violate such laws including copyright or trademark laws. You may download extracts of the Material for Your own personal use. You must retain all copyright and other proprietary notices contained in the original Material on any copy You make. You may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the Material, in whole or in part or reproduce, display, publicly perform, distribute, or otherwise use the Material in any way for any public or commercial purpose. You hereby acknowledge that You do not acquire any ownership rights by viewing or downloading the Material. Except as otherwise expressly permitted under these terms or applicable law, no copying, redistribution, retransmission, publication or commercial exploitation of the Material will be permitted without the express permission of Titan and the copyright or trademark owner. The trademarks, logos and service marks (the “Marks”) displayed on the Web Site are owned by Titan or third parties. You are prohibited from using those Marks without the express, written permission of Titan or such third party. Reliance on Information 

The information and ‘Material’ on the ‘Web Site’ is not intended to amount to advice on which You can rely.  Although we make every effort to avoid errors on the ‘Web Site’, the ‘Material’ may contain inaccuracies or typographical errors. The ‘Web Site’ and the ‘Material’ is provided “as is” and on an “as available” basis and Titan makes no guarantees, promises or endorsements with regard to the accuracy, reliability, relevancy, completeness, or timeliness of the ‘Material’ or about the results to be obtained from using the ‘Web Site’ and the ‘Material’. We therefore do not accept any responsibility for any errors, omissions, or any inaccurate ‘Material’ on the ‘Web Site’. Furthermore, ‘We’ do not promise that the ‘Web Site’ and/or the ‘Material’ will be uninterrupted or error free or that any defects will be corrected. ‘We’ will not be liable for any loss or any damage arising out of or in connection with access or use of the ‘Web Site’ and/or the ‘Material’ except that nothing in these ‘terms’ excludes or limits any liability for losses which may not be lawfully excluded or limited by applicable law. Our Liability 

We promise to You that any product purchased from the ‘Web Site’ is of satisfactory quality and reasonably fit for the purpose for which the product was supplied. Our liability for losses You suffer as a result of Us breaking these terms shall be limited to the purchase price of the products You purchased and any losses that are a foreseeable consequence of Our breaking the agreement. Losses are foreseeable where they could be contemplated by You and Us at the time Your order is accepted by Us. We are not responsible for indirect losses which happen as a side effect of the main loss or damage or losses which are not foreseeable by You and Us (such as loss of profits or business). Nothing in the ‘terms’ is intended to exclude or limit in any way Our liability for fraud or fraudulent misrepresentation, death or personal injury caused by Our negligence or deliberate breaches of the ‘terms’ by Us that would entitle ‘You’ to terminate the contract between ‘Us’.

The ‘Web Site’ contains hyperlinks to websites owned and operated by third parties. We do not accept any responsibility for the content of third party websites or web pages, nor do We accept responsibility for any losses or penalties incurred as a result of Your use of any links or reliance on the content of any website to which the ‘Web Site’ is linked.

We are committed to maintaining Your privacy. Titan does, however, gather certain information that You provide to the ‘Web Site’ when a Titan product is ordered. The information Titan requests, is the minimum We believe necessary to achieve this goal. Titan may use the information it obtains relating to You, including Your name, mailing address, email address, telephone number, fax number, credit card information and use of the ‘Web Site’, for its internal business and marketing purposes. Warranty Information & Customer Consent – Custom Made Products 

All of our custom made products are specifically manufactured as cosmetic, sport or personal protective equipment. They are manufactured on the understanding that you have already consulted with your dentist as to your dental requirements. We are manufacturing professionals, not dentists. While the materials used for this process frequently appear safe, infrequent side effects can occur. Tooth and gum sensitivity or soreness is the most common side effect. Soft tissue irritation can also occur. If You experiences these or other adverse symptoms, You should stop using the custom made product immediately and consult your treating dentist or doctor. If You have any known chemical sensitivity or allergic reactions to any dental ingredients please be sure to inform us directly prior to placing your order with us. Please also note that the home impression technique is not suitable for people who have undergone crown and bridgework, are undergoing orthodontic treatment or for children who have milk or loose teeth. If you have a need that exceeds the above, you may not be a suitable candidate for our custom made products
